| 摘 要： | 农民是新农村建设的主体,而在当下的新农村建设中农民并未发挥出主体作用.农民主体性和主体地位的缺失,与农村法制建设缺乏农民主体性的视野,缺乏把保障农民主体地位作为制度建设方向的意识和努力有着直接的关系.新农村法制建设只有坚持"以农民为本",把农民主体性和主体地位作为主线贯穿其中,着眼于农民主体性的提升和主体地位的获得,处理好农民经济权利和政治权利的关系,并构建农民的利益代表、表达机制,利益参与、决策机制,利益救济机制,才能从法制层面促使农民作为最终解决农村困境的主体性力量发挥作用.
