| 摘 要： | 以动物福利为导向的现代动物保护立法,已经有近两百年的制度发展史。与之相比,我国现行动物保护法,尚非真正意义上的以保护动物个体利益为目的的法律。其立法的主要缺陷表现在:在立法宗旨上,动物只是纯粹的资源,忽视了动物个体的利益;立法分散、法律规定少;受保护的动物范围有限;法律缺乏执行力。动物福利立法的缺失,带来诸多不良社会后果,鉴于此,中国需要健全动物保护法,将动物福利理念贯穿到现有法律中,其具体立法原则应当坚持:第一,残酷非法化;第二,基本福利为补充。
