| 摘 要： | 从古到今，仪式一直伴随着人类社会。在婚丧嫁娶、节日庆典、诉讼裁判等基本人类活动中，仪式都贯穿其中。通常仪式被定义为一种人类学现象，但笔者考察认为，仪式还具有一定的法文化价值。即：仪式具有社会控制的性质和能力；仪式能够解决一定的社会纠纷；社会等级及地位尊卑同时依靠仪式来加以规定和确认。

| Abstract: | From past to present,rituals run through human activities such as marriage,funerals,holiday celebrations and litigation.Rituals are generally defined as an anthropological phenomenon,but the author holds that they also embody somewhat values of legal culture:rituals have the nature and ability of social control;they are able to solve certain social conflicts and determine and confirm social hierarchy and position. |
