无船承运人制度比较研究

随着集装箱运输和国际货物多式联运的蓬勃发展,无船承运人在国际货物运输中日益发挥着不可替代的作用。然而,长期以来中国关于无船承运人的理论研究及相关立法却相对滞后,无船承运人的概念、性质、法律监管等问题尚不明确,造成中国货运市场秩序混乱。针对这一问题,在阐述了无船承运人的概念和法律地位的基础上,通过比较主要航运国家无船承运人管理制度的特点,并结合中国无船承运人业务实践,对中国无船承运人管理制度现存问题进行了分析,提出了完善中国无船承运人管理制度的建议,如推广无船承运人责任保险制度及明确无船承运人破产时债权实现的程序等。

Comparative Study on Management System of NVOCC

With the rapid development of containerized freight transport and international multi-modal transport,NVOCC has been playing an indispensable role in international transport market.However,the theoretical study on NVOCC and relevant legislation are lagging far behind for long in China.The concept and nature of NVOCC and the supervising system to it are not clear enough to make China's transport market in regular order.Expounding the concept and legal status of NVOCC,the different NVOCC management systems in several countries are compared with each other to analyze some existing problems found in China's management system.Some suggestions are therefore put forward including setting up the system of liability insurance and the implementation procedures of creditor's equity when an NVOCC is bankrupt.
