| 摘 要： | 国际许可协议中的限制性条款给经常作为技术被许可方所属国的发展中国家带来了极大的危害。素有"南北对话的讲坛"之称的联合国贸发会议虽几经努力,发达国家与发展中国家终未能达成一致。TRIPS协定对限制性条款的管制最终采用了发达国家主张的"竞争"标准,作为发展中国家的中国应坚持"发展"与"竞争"相结合的立法标准。

| Abstract: | Restrictive clauses in international licensing agreement do harm to the developing country,to which the licensee always belongs.Although UNCTAD made great efforts,the developed and the developing could not agree with each other.The WTO's Agreement on TRIPS to control the restrictive clauses adopt the view of the developed countries,that is the standard of competition.China,as a developing country,should take the standard of combining the development with the competition to control the restrictive clauses. |
