| 摘 要： | 村民自治制度与土地制度的有关规定尚需进一步理顺，本文仅举村农民集体土地所有权加以说明，对立法将村农民集体土地所有权简单地规定代行主体为村集体经济组织或者村民委员会的规定进行分析，认为应对集体经济组织和村民委员会、村民会议、村民代表会议的关系进一步厘清，进行总体的制度安排和规范性法律文件的系统化，完善村民自治立法和土地制度立法。

| Abstract: | Village self - government system and the relevant provisions of the land system require further straightened out. The article illustrates the collective land ownership of farmers, on the legislation of collective village ownership of land farmers simply to act as the main requirement for the village collective economic organizations or villagers committees analysis of the opinion that the collective economic organizations and village committees, village meetings, village representatives to further clarify the relationship for the overall institutional arrangements and normative systematization of legal documents, improve the villagers self - government system of legislation and land legislation. |
