| 摘 要： | 虚拟财产作为法律规制的对象不仅在于其具有现实财产的基本属性,而且在于其作为财产的功能性。虚拟财产权是网络经济条件下的一种重要的财产权形式,它具有不同于现实财产的涵摄、扩张和渗透功能以及虚拟财产的交易机制,尤其是将无体财产的功能性渗透到虚拟的世界,扩大了现实法律对社会财产调整领域。将虚拟财产权纳入财产权的范畴,重构社会财产交易的法律秩序,有利于社会利益关系的均衡与和谐。

| Abstract: | The virtual property is the object regulated by law because it not only has the basic characteristics of real property but also the function of real property.A virtual property right is an important form of property right under the condition of net economy.It has functions of subsumtion,expansion and seepage that are different from those of real property and exchange mechanism to establish virtual property.It makes the function of intangible property seep into the virtual world and enlarge regulation field of law.Taking virtual property right into property right and reestablishing legal rule for social property exchange are helpful for balancing and harmonizing the social profit relationship. |
