现代化建设中人与制度关系的哲学阐释

人在现代化的实践中创设和变革制度，又通过生成着的制度提升和塑造自己。制度要规范和约束人们的行为，但这并不意味着要否弃人的自主性和能动作用。制度对人的自由既是约束也是保障。制度的贯彻落实是他律和自律的统一。在制度建设中，既要确保社会运行井然有序，又要最大限度地发挥社会成员的主动性和创造性。在人与制度、法律的关系上，人是目的，制度、法律是手段，“以人为本”与“依法治国”是一致的，将二者统一于当代中国社会主义现代化建设的实践中，是党的执政治国理念的一次新的提升。

Philosophical Explanation of Relations between Person and Institution during the Course of Modernization Construction

Man can create and innovate institutions during the practice of modernization,and he can also develop and shape himself by creating institutions.The roles of institution are to regulate and restrict people's activities,but it does not mean that we human beings do not need any freedoms or self-determinations.It is institution that inhibits and safeguards mankind himself.So to speak that there is a unification of self-discipline and heteronomy. And we shall keep our society in order,and at the same time we shall take advantage of our positive and creative characters during the course of institution construction.If we talk about the relations among person,law and institution,we should say that person is the aim,and institution or law is the instrument.We shall also see that there are consistent logics between person-oriented principle and rule-of-law principle,and it is a new advance of the governance concept that CPC makes two principles unified together during the practice of contemporary China.
