| 摘 要： | 利益冲突是腐败之源,防止利益冲突制度是中国预防腐败制度体系建设的基础。在经济转型和社会转轨时期,中国防止利益冲突制度多呈现低效率,没有取得预期的制度效果。这与中国的文化环境,尤其是计划经济体制传统密切相关。计划经济体制下的全能主义政治思维、特殊的权力结构和特殊的社会结构为利益冲突的实现提供了思想观念、权力结构和社会结构支撑。要实现对利益冲突的有效预防,必须从源头上解决导致防止利益冲突制度低效率的思想观念、权力结构、社会结构和权力制约模式等问题,为防止利益冲突制度的良性运行提供适宜的制度环境。

| Abstract: | Conflict of interests is the source of corruption. The system that prevents conflict of interests is the foundation for the anti-corruption system. During the transformation of economy and society, the efficiency of the system that prevents conflict of interests is so low, which is related to our traditional cultural situation, especially related to the central planning system. The thinking of omnipotent doctrine, the structure of the power and the structure of society provide the support for conflict of interests. Only by solving these problems can we provide a suitable situation for the system that prevents the conflict of interests. |
