论政府与法制现代化

法制现代化是发展中国家颇为关注的社会问题，政府在法制现代化进程中的角色如何，不仅学术界应予考虑，而且发展中国家政府也必须作出回答。发展中国家可以借鉴西方国家形成的法秩序，但不可照搬和重演。发展中国家的法制现代化应在一个强有力的政府引导下进行，日本、新加坡已经给我们提供了一种范式。法制现代化不仅需要政府的主导，而且需要一个强劲而开明的政府来主导。

Government and Legality Modernization

Legality modernization is involved in social m atters that the developing countries pay much more attention to. About the role of government in the process of legality modernization, not only academic fields should be considering but also the government of the developing countries shoul d make an answer, because the problem of the government role concerns with the i mproving progress of the developing countries and concerns with whether the new law order can efficiently promote social economy prosperity and the development of public welfare. The paper makes a comparison between the traditional form and developing background. Again, based on this comparison, the paper, in the ligh t of the experience from Japan ans Singapore, points out that government can and should play a leading role in the legality modernization of the contemporary de veloping countries.
