试谈未成年人犯罪的刑事政策

未成年人犯罪早已有之,但二战以来,其呈现出犯罪急剧上升、恶性案件持续增多、犯罪年龄日趋低龄化等惊人势头,以致成为各国共同面临的一个突出社会问题,被称为"三大社会公害"之一.在我国,未成年人犯罪在20世纪80年代和90年代也呈现出与世界各国相同的态势,因而引起社会各界的关注.只有通过分析未成年人犯罪的成因、特点等问题,确立综合治理的刑事政策,才能更好地预防未成年人犯罪,关心和爱护未成年人的健康成长.

On the Criminal Policy about Crimes by Minors

Crimes by minors have a long history, but since World War II, the type of criminal has increased rapidly, the crimes become more seriously, and the minors who commit crimes become younger and younger, so crimes by minors have become a very serious social problem the world over, which is called one of "the three social evils". In China, crimes by minors had the same tendency as the foreign countries in the 80sand 90s of the last century, therefore, it draws more attention of the society. The paper analyzes the reasons and characteristics,and sets up the criminal policy of comprehensive administration in order to guard against the crimes by minors in a better way.
