| 摘 要： | 从诸法合体到刑民分野再到刑民互动,侵权法与刑法的历史关系千丝万缕。侵权责任法是救济法,刑法是惩罚法,两者通过不同的手段修复被破坏的社会关系。法律的任务在于重建被破坏了加害人、被害人和社会之间的正常利益关系的平衡,使得社会恢复和谐,这一任务的实现离不开刑法与侵权法的互动。刑民割裂是法律关系不正常的状态。正在制订中的《侵权责任法》应正确处理刑民分野、刑民互动等关系,并摒弃所谓刑事优先的错误观念。
