试论道德对法律的支持

作为社会调控系统中的法律与道德 ,尽管各具不同特性 ,但二者又有着紧密的联系 ,法律的确立和实施都需要有道德的支持。笔者认为 :良法的价值基础源于社会伦理道德的普遍性标准 ;道德的柔性、内生性、自律性的规范特性与法律的刚性、外生性、他律性的规范特性正好优势互补 ;系统论的基本观点给道德对法律的支持作了最好的诠释。

On the Moral Help for Law

Law and morality, being two ways of social management system and having different nature, intercommunicate and have countless ties. The founding and enforcing of law need moral help. The author believes: the common standard of social morality is the value resources for good law; the characters of moral rule that are flexibility, self-engendered,selfdisciplinal can be a supplement for the characters of legal rule that are rigid, exogenous, heteronomy; the basic viewpoints of system theory are the best interpretation for moral help .
