| 摘 要： | 实证主义法学方法所坚持的纯粹法学的思维方法为我们提供了实现法学科学性的方法论，为此必须坚持法学科学性与伦理价值相分离的历史思维方式。只有这样的思维方式才能实现法律规范及法学的逻辑性、推理性和体系性，实现法律的独立性、确定性和可预测性。
