| 摘 要： | 是否以人权保障为审前羁押制度的出发点,是衡量现代社会中审前羁押制度是否具备正当性的关键。我国审前羁押制度在实践中确实还存在不少问题,对人权保障力度不够。本文从人权保障的角度审视我国现行法律规定下的审前羁押制度,分析审前羁押在人权保障方面存在的问题并提出完善的建议。
