自然法与退化论——对J.2.1.11后部的破译

本文通过对 J.2 .11以及优士丁尼《法学阶梯》中 17个关于自然法的片断的分析 ,揭示了 J.2 .11所持的历史解释模式是自然状态——市民社会的两段论 ,通过援引影响罗马法的希腊哲学观点 ,进一步说明了上述历史解释模式隐含的退化论前提 ,从而建立了自然法的高级法地位与退化论的历史哲学的关联。最后阐明了自然法主体范围的缩小性变迁的悲剧意义

Natural Law and the Theory of Degeneration--Interpretation of J.2, 1. 11 (Part Ⅱ)

Based on the analysis of J 2 11 and 17 fragments from Justinius's Institutiones, the paper shows that the historical interpretation mode as employed in J 2 11 is a natural state civil society duality. With the Greek philosophy, which is the basis for the Roman Laws, as a fundamental theory, the author further points out what lies under the such mode is an implied theory of degeneration, and thus establishes the link between the advanced status of the natural law and the historical philosophy based on the theory of degeneration. The paper concludes with the tragic significance of the shrinking of the subjectivity of the natural law.
