| 摘 要： | 针对将破产法的适用范围扩大到自然人这一现代各国破产立法的统一趋势问题，指出破产免责是自然人破产制度的重要组成部分，在自然人破产的救济政策中处于核心地位，也是自然人破产制度能否顺利实施的重要保障。研究采用比较分析的方法，结合各国立法、我国新《破产法》和2003年的破产法草案所体现的思想，对自然人破产免责的内容作了分析论述，阐述了破产免责制度的法律价值，对破产免责制度提出了个人的想法。
