论产权的基本结构

“产权”不仅仅是个简单的法律概念，而且是反映人类经济活动和经济行为关系的经济学范畴。随着社会经济的多元化和多样化发展，现实的产权关系已不再是不可分割，它逐渐地形成包括经济资源所有权、使用权、收益分配权、处置权、以及以上4种权利的转让权的基本权利结构。产权的基本结构在经济活动中也是根据具体的制度安排和社会环境，表现为权利组合的多样性和变化方向的多元性。随着经济改革的不断深化，人们的经济行为和经济活动开始自觉地以明确“产权”关系为前提，“产权”已经成为涉及经济、法律、政治、文化各个方面的十分重要的理论范畴。
