法院审理专利侵权诉前禁令案件问题探析

诉前禁令是对被控侵权当事人行为的强制性禁止,禁令一旦发出,在全中国范围有效,效力非常强。法院一旦发出错误禁令,被控侵权人的损失是巨大的。从程序设计上看,通过对禁令的科学分类,建立诉前少出错,诉中不出错的纠错机制,使专利权人或者利害关系人的损失在诉前能得到及时控制,保障被申请人不会因错发禁令蒙受更大的损失,切实提高诉前禁令制度在专利权司法救济中的功效。通过对专利诉前禁令进行科学划分,并建立与之相应的正当程序,从立法设计和司法实践两个角度采取措施发挥专利诉前禁令在制止专利侵权行为,保护专利权人或者利害关系人的合法权益中的作用。
