社区治理创新中的软法之治

相对于硬法之治,软法之治更为注重协商与民主、对话与互动,在本质上同社区治理创新的理念相契合。将软法之治引入社区治理创新中需要培育多元主体共治合作、社区行政管理组织指导服务、社区治理主体民主协商等软法治理理念。社区治理创新中的软法之治具有侧重反映社区多元治理主体共同意志,制定形式多样、简易、灵活、高效,实施依靠“利益诱导-柔性惩罚”机制,制定程序具有更高程度的民主协商性等特征。社区治理创新中法治体系的构建需要从单一的硬法治理模式转向“软硬并举”的混合法治理模式。

Compared with hard law governance, soft law governance pays more attention to consultation and democracy, and dialogue and interaction, whose essence is accorded with the concept of community governance innovation.
