| 摘 要： | 各国民法典总则结构的总体叙述模式虽大体相同,但也存在着各种具体差异,且各有特点与可资借鉴之处。中国大陆的民法典总则草案也有自己的特点与不足,其应然结构应在结合自身实际,并参照其他国家的民法典总则、吸取其优点的基础上确立。
