| 摘 要： | 刑法的空间效力规定一方面可作为处罚条件而把握,另一方面可作为指引刑法适用的冲突规范而把握。特别值得一提的是,采取后一种理解,可以促使我们以国际私法学为借鉴,运用直接适用法的理论,突破不适用外国公法的传统,为刑法空间效力冲突的协调找到新的途径,现实意义极为重大。

| Abstract: | On one hand,the provisions of the spatial effect of criminal law can be treated as the punishment conditions,on the other hand,they can be regarded as the conflict rules to guide the application of the criminal law.In particular,based on the latter understanding,we can use the theory of law of direct application in private international law to breakthrough the tradition of not using foreign criminal law and find new ways to coordinate the spatial effect conflict of the criminal law. |
