| 摘 要： | 民营经济已经成为社会主义市场经济的重要组成部分。民营企业在发展中面临产权中的法律风险、企业设立时潜在的法律风险、合同签订和履行中的法律风险、融资中的法律风险及商业秘密保护中的法律风险。民营企业要化解法律风险：规范公司的设立行为，明晰产权；提高防范法律风险的意识；合理评估企业法律风险．建立风险防范机制；建立专兼结合的防范法律风险的人才队伍以及加大对肪范法律风险的投入等。
