对我国土地征收与安置补偿的思考

目前我国法律对土地征收（征用）的范围、征收程序、补偿标准及发放原则、补偿安置方式等缺乏明确规定，应对此作出一些构建：明确征地补偿的原则和受益主体；保证土地征收程序公开公正；扩大补偿范围，确立市场化的补偿标准；建立被征地农民社会保障体系；实行货币安置、社会保险安置、土地使用权入股安置或征地补偿费入股、留地补偿安置、土地债券补偿安置、替代地补偿安置和就业补偿安置等多种形式的复合安置方式。

China＇s Land Expropriation and Resettlement Compensation

At present, the laws in our country on land expropriation （requisition） range, the collection procedure, standard compensation and payment principle, compensation resettlement methods are not clearly defined, and some constructions should be done： to make clear the principle and the main benefit body of land compensation; to ensure open and fair process of land acquisition ; to expand the scope of compensation, to es- tablish market-based compensation standard ; to establish the social security system for farmers whose land is requisitioned. It mainly implements many kinds of compound placement methods as follows： the currency resettlement, the social security resettlement, the land-use rights or land acquisition compensation of buying stock, the remaining land compensation resettlement, the land stock compensation resettlement, the substituting land compensation resettlement, and the employment compensation resettlement etc.
