役权的立法选择

摘    要:役权是用益物权的重要组成部分,为各国民法所普遍规定。我国在制定物权法中,应当从如下方面规定役权:一是采取地役权一元立法模式,不规定人役权特别是居住权;二是采取相邻关系与地役权的并存结构,分别在所有权和用益物权中加以规定;三是在地役权的名称选择上,地役权宜改称为不动产役权。

Abstract:Servit is widely regulated by many countries civil law as an important component of usufructus. Servit should be regulated in the following aspects in the enactment of real law of China: first, adopting the unitary legislative pattern of easement, without regulation of personal servitude, especially the habitatio; second, adopting the co-existence of adjacent relation and easement and regulating it in ownership and usufructus respectively; third, easement should be renamed servit of real property in the name selection.
