社区矫正判前调查评估制度探析

判前调查评估作为社区矫正的基础性工作,是法官判定犯罪人人身危险性以及能否适用社区矫正的重要依据。判前调查评估应坚持判前调查和风险评估并重,而不应只强调判前调查环节。在当前的立法和司法实践中,社区矫正判前调查评估的制度层面和具体运行都存在着许多问题：制度建设层面缺乏确定和明晰的规范,制度运行层面有流于形式的危险。针对这些问题应做具体的完善：调查评估应被确定为社区矫正判决前的必经程序;调查评估主体应做确定性规定;判前调查的内容设置应科学明确;矫正风险的测评标准应尽快出台。

Therefore, we should aim at the specific problems and complete the pre-judgment investigation and assessment mechanism; The investigation and risk assessment should be identified as a necessary procedure before the judgment of community corrections; The investigation and assessment subject should he defined certainly; The contents of investigation should be set clear and scientific; The risk assessment standards should be laid down as soon as possible.
