| 摘 要： | 在美国规章制定程序和行政裁决程序中,行政机构不将其意志强加于利害关系人,通过规章的正式听证、协商程序、生效等待期、国会审查,以及行政裁决程序中的行政法官、ADR等制度,保障利害关系人的民主参与和决策权,相应达成行政机构与利害关系人的意思表示一致。
