社会转型背景下宅基地使用权初始取得制度的完善

我国现行宅基地的使用权制度是在集中资源优先发展重工业的背景下发展起来的，与计划经济、城乡分割体制相适应，采取了均分、无偿、行政审批的取得方式，宅基地使用权取得制度被异化，限制了集体和农民的土地权利，造成了土地资源的浪费。在城市化、市场化背景下，宅基地利用必须符合效率原则和城乡平等原则，应从恢复宅基地使用权取得的私法性质、完善宅基地使用权取得程序、逐步推行宅基地使用权的市场化配置、完善救济制度等方面对现行宅基地使用权取得制度加以完善。
