主办警官办案责任制的权力结构分析

主办警官办案责任制是郑州市金水公安分局在公安体制改革中采取的新举措。此举确立了主办警官在公安执法中的合法主体资格,是程序正义在公安工作中的具体体现,也是当前提高执法质量的有力措施。传统的警务模式权力结构存在不均衡的弊端,外部权力呈现“三角形”模式,内部权力呈现“倒三角形”模式;主办警官办案责任制使得权力形成“菱形”模式的正态分布。主办警官办案责任制肯定了警察自决权,赋予主办警官更多的自由裁量权,对这种“自决权”应从加强自控、建立内部监督机制和强化外部监督体系等方面予以监督制约。

Anatysis of the power strueture of the responsible potice-officer system

The system of the responsible police-officer (SRPO) is an action in the reform of police system in Jinshui police station of Zhengzhou city . This action confirmed the quality of legal excutive, it is not only the specific embodiment of the procedural justice, but the powerful measure to enhance the quality of police work.The traditional police work has the disadvantage of off-balance power-structure, which is that the outside power-strucfure is a pyramid model and the inner power-structure is a up-sidedown pyramid model. The SRPO has made the power-structure a diamond model. The SRPO has confirmed the police self-decided power and given the responsible police-officer more free-decided powers and argued that it is necessary to superise the self-decided power from three aspects as follows:enhancing self-controt, estabtishing inner-supervised system and enhancing outside-supervised system.
