| 摘 要： | 按照西方比较通行一种的政治理论,即大家熟悉的社会契约论,国家的权力因公民委托而来,国家的目的只是为了维护公共秩序,保障公民权利。公民权利是国家权力的源泉,也是国家权力配置和运作的目的和界限。本文以"彭水诗案"为样本,阐述了上述法理。

| Abstract: | According to the social contract theory,which is very popular in the western world,government's authorities originate from people's trust;the task of the government is to ensure public order and protect citizens' rights.Citizen's rights are the source of the government's power;it is also the end and boundary of the distribution and exertion.Studying the case of Penshui poem,this paper explains the above jurisprudence. |
