| 摘 要： | 从沉默权的渊源及法律内涵出发,一个民主国家法制应坚持个人本位的法律价值观,建立沉默权制度。在我国刑事诉讼领域中确立沉默权制度,既要维护人权,又必须兼顾我国司法实际,做到制度确立与限制同步,以真正实现利益与正义的平衡。

| Abstract: | In this article, the author describes the origin, connotation and value of the right to silence and points out the necessity of setting it, according to the reality of our country, to assure the democracy. Meanwhile, the author points out that we should not only to set the right to silence, but establish responding restrictions of using it to realize the uttermost fairness and advantages of laws. |
