中国地方政府实施RCEP电子商务规则的现状、问题与展望

《区域全面经济伙伴关系协定》(Regional Comprehensive Economic Partnership,RCEP)电子商务规则是亚太地区达成的首部电子商务领域规则,具有规则涵盖范围广、缔约国经济发展水平差距较大等特点,是深入推进高质量共建“一带一路”合作的重要战略举措。2022年1月1日,RCEP正式生效实施。从RCEP准备阶段至生效实施后,中国各地方政府纷纷发布了实施RCEP或其电子商务规则的政策措施。相较于中央政府的实施,地方政府实施手段灵活,可以结合区域实际下沉农村电子商务。但在地方政府实施中仍存在进程差距大、条文对接少、合作主体和发展能力的包容性不充分等一些值得探讨的法律问题,此类问题的解决路径可为中国各地方政府将来推出相关政策措施提供有益借鉴,从而促进全国范围内RCEP电子商务规则实施工作的开展。

Current Situation, Problems and Prospects of Implementing RCEP E-commerce Rules by Local Governments in China

The Regional Comprehensive Economic Partnership RCEP e-commerce rules are the first rules in the field of e-commerce in the Asia-Pacific region. They are characterized by a wide coverage of rules and large gap in the level of economic development of contracting countries. They are important strategic measures to further promote high-quality co-construction of "the Belt and Road" cooperation. On January 1, 2022, RCEP came into effect. From the preparation stage to the effective implementation, Chinese local governments have issued policies and measures to implement RCEP or its e-commerce rules. Compared with the implementation of the central government, the implementation means of the local government are flexible and can sink the rural e-commerce in combination with the regional reality. However, there are still some legal problems worthy of discussion in the implementation of local governments, such as large process gap, few provisions docking, insufficient inclusiveness of cooperation subjects and development capabilities. The solution path of such problems can provide useful reference for Chinese local governments to launch relevant policy measures in the future, so as to promote the implementation of RCEP e-commerce rules nationwide.
