| 摘 要： | 研究空白票据的一般法理可为空白票据法律制度的建立提供理论基础。通过对英美法系和大陆法系票据法关于空白票据规定的比较分析和对有关空白票据的学说、判例进行讨论、评价,探讨了空白票据的特质和空白票据权利的行使、限制及其效力等空白票据的基本法理问题。

| Abstract: | Research on the general legal principles of the blank cheques can provide the theoretical basis for setting up the blank cheque's law system. Through the comparisons and analyses of the blank cheque's regulations between the Anglo-American law system and the continental law system as well as the discussions and the evaluation of the blank cheque's theories and cases, this paper probes into the blank cheque's characteristics, its implementation and restraint of rights, its efficacy and some other fundamental legal principles. |
