| 摘 要： | 鉴于提单管辖权条款效力之不确定性,论述立法、司法审判对协议管辖的限制,着重探讨影响该类条款效力的其他诸多因素,如条款的形式与实质要求、法律适用、扣船制度和不便管辖等,并认为有必要就海事纠纷协议管辖达成国际公约。

| Abstract: | As jurisdiction clause is invariably laid down in Bills of Lading, and in view of the uncertainty of its legal effect, discussion is made of the restrictions both in legislation and judicial proceedings and focused on the influences of such elements as the form and essence of the clause, applicable law, arrest of ships and forum non conveniens, etc. And it is thereupon held that it is essential to enter an international convention on the choice of forum clauses in respect of maritime claims. |
