| Abstract: | The clause that the state value and guarantee human rights has been affinned by the constitutional amendment . However the problem of guaranteeing human rights can be solved only by the clause of human rights having been affirmed by the constitution. The author elaborates some views from the aspects of legal construction, institutional construction , raising the sense of human rights, etc. |
