| 摘 要： | 作为治理的基本要素,"共识"不同于单纯的"同意"(consent)、"治理"有异于传统的"管理"。应当以"共识导向"为基础,以民主治理为依托,探索生态法治建设的五个新思路:基于民主协商的生态共识、选举民主与"绿色法治GDP"新考评体系、社会自治与生态司法改革、谈判民主下互动式生态权益救济之道、生态法治的组织架构创新。
