论传媒法的宪法属性

传媒法是调整传媒组织与国家的关系、传媒组织与一般社会成员的关系的法律规范,其核心是调整政府权力与公民权利的关系。因此,传媒法具有宪法属性。英国大众传播媒介的发展、传播法规的制定、实施与废除,都与现代宪法规定的国家或政府的权力与宪法应保障公民享有的基本人权、新闻与出版自由、民主等权利紧密相关。我国尚无现代意义上的传媒法。在传媒的立法和实践领域,需要我们对政府权利和公民的权利给予恰当配置,限制政府公权力的范围,培养公民的能力,保障公民的权利。
