文化产业发展的立法现状与法制构建

文化产业被确定为我国国民经济支柱性产业,构建我国现代文化产业体系迎来新的机遇,为此建立健全文化产业法律法规体系成为发展文化产业的必然要求。我国文化产业立法缺乏系统性和规划性,立法阶位较低,地方立法不完善,缺乏总体的文化产业促进立法,应加快文化产业立法步伐,将现有政策法制化;加强制订文化产业基本法,尽快出台《文化产业促进法》;提升文化产业相关行业立法的法律层次,完善文化产业地方法规,开展文化产业法律、法规、规章的清理与整合,使文化产业立法保持统一性、协调性和科学性,从而为我国文化产业的快速发展提供健全的法律保障。

Legislative Situation and Construction of Legal System in the Development of Culture Industry

The identification of culture industry as a pillar industry of national economy brings new opportunities to the construction of modern culture industry system in our country.For this reason,establishing and perfecting the legislative and legal system becomes an inevitable requirement for the development of culture industry.This article reviews and analyzes the legislative situation in culture industry,pointing out that the culture industry legislation in China lacks systematicness,as well as planning.Currently,the legislation has a low status and the local legislation is imperfect.An overall Promotion Law for culture industry is needed.On this basis,this article proposes speeding up the legislation for cultural industry,legalizing the current policies;strengthening fundamental legislation for cultural industry and introducing The Cultural Industry Promotion Law as quickly as possible.It is also suggested that the government promote the status of the legislation in culture-related industries,integrate local laws of cultural industry,and launch movements for the sorting out and perfecting of current laws and regulations for culture industry,to make contributions to the consistence,coordination and scientific nature of the legislation of culture industry,which provide a sound legal security for the rapid development of our cultural industry.
