| 摘 要： | 越来越严重的环境问题威胁着人类的生存，也冲击着民法的传统理念和制度规范。为此在国内外对环境法和民法沟通与协调的研究，特别是通过民法手段解决环境问题的专门研究的基础上，以现有民法制度为纬度，引入可持续发展的理念，论述了构建具有生态价值的民事法律关系的理念。提出法律关系的生态化必须以民法的基本制度为基础，加以适当的更新与改造。
