铁路旅客人身伤害的赔偿责任

在铁路运输企业对于旅客的人身伤亡不具有过错的大前提下,我国铁路旅客人身伤亡赔偿采取的是限额赔偿制度;铁路旅客运输实行强制保险制度,当旅客发生意外人身伤害时,根据人身保险合同还享有得到保险赔偿的权利;铁路运输企业对旅客在运输过程中人身伤亡的赔偿责任应采用严格责任归责原则;由于第三人造成旅客伤害的,铁路运输企业对第三人所致旅客伤害有先予赔偿的义务,铁路运输企业赔付后,有权向有责任的第三人追偿。
