| 摘 要： | 《国家赔偿法》确立了我国国家赔偿制度 ,其中刑事赔偿程序法律规范占有重要地位 ,但存在不少缺陷 ,如赔偿义务机关多元化 ,赔偿机关权力过大 ,程序复杂繁琐 ,环节过多 ,缺乏配套立法等。应坚持程序公正原则 ,简化程序、提高效率原则 ,先行自由选择原则 ,强化司法救济原则等来完善国家刑事赔偿程序立法。

| Abstract: | National Compensation Law has established the national compensation system in our country.The legal norm of criminal compensation procedure is the essential part of it,however,there exists many defects such as too many compensation duty agencies and their excessive power;the complicated procedure and links;and the lack of complete legislation etc.Thus the paper puts forward some principles to improve the legislation of the national criminal compenstion procedure. |
