法家的"法治"思想辩析

法家的“法治”思想是中国传统法律思想发展的高峰，在中国法律思想史上占有特别重要的地位。在现今正致力于法治建设的社会语境下，“法治主义”又成为学术界和实务界热门的语汇，先秦法家的“法治”思想再次引起人们的关注。通过对法家所提出的“法治”思想的理论基础和特色的分析，指出这种“法治主义”实质上是一种极端的人治，与现代法治理念有着根本的区别。
