| 摘 要： | 惩罚性赔偿是加害人向被害人支付的,超过其财产损害范围的一种金钱赔偿。惩罚性赔偿不仅具有补偿的功能,而且同时具有制裁和预防的功能。环境侵权作为一种特殊的民事侵权行为,完全适用传统民法的同质赔偿原则显现出很大的局限性,无法实现弥补受害人实际损失的目的。因此,在适用同质赔偿原则的基础上,应当有限度地适用惩罚性赔偿原则。

| Abstract: | Punitive compensation is that the injuring person pays the injured one more compensation than the value being damaged.Punitive compensation is not only to have compensatory effect but also to have preventive and punitive effects.Environmental infringement is a special civil tort.If we deal with environmental infringement by the principle of parity compensation,it can't reach the goal to compensate the injured person.So more limited punitive compensation should be done besides parity compensation. |
