论医方对患者知情同意侵权的抗辩事由

知情同意权是患者在医疗活动中享有的一项法定权利。但基于医方在医疗活动中的多重角色和特殊地位，应该赋予其在一定条件下享有对应的抗辩权利。一般而言，在医方的强制医疗行为、履行告知义务的自由裁量行为、因不可抗力或者意外事件导致告知义务履行不能以及患者身处无力行使状态、拒绝和放弃、家属代理时具有过错等情况下，可以构成医方对患者知情同意侵权的抗辩事由。
