社会矛盾化解的法哲学分析

目前中国正处于社会矛盾的"凸显期",学界从不同角度提出了种种社会矛盾化解对策,但已有研究缺乏法哲学上的整体性追问,各种社会矛盾化解对策无法在最深层的本质上获得某种内在关联,以致社会矛盾化解对策欠缺深刻的"元理解"而碎片化。社会矛盾化解的法哲学根基是重塑的法权理论。法权是权力、权利、义务、责任的统一体,社会矛盾化解是一张由权力、权利、义务、责任组成的复杂的、多元的力量关系图,法权是社会矛盾治理革命的"元叙事",纷繁复杂的社会矛盾化解于法权逻辑的框架中得以清晰地解释、融汇、贯通和发展。

The Analysis of Legal Philosophy of Resolving Social Contradictions

Nowadays,China is in a "highlighted period" of social contradictions.Educational circles put forward the countermeasures to solve a variety of social contradictions from different angles,but the study is lack of the integrity of questioning of philosophy of law.At the same time,the countermeasures for various social conflicts resolved cannot get some essentially in-depth and internal connection,so that the countermeasures are lack of deep "understanding" and become fragmented.The root of philosophy of law of resolving social contradictions is the remodeling of the theory of legal right.Legislative power is the unity of power,rights,obligations,and responsibilities;the resolution of social contradiction is a complex and multivariate force diagram consisting of power,rights,obligations,and responsibilities.Legal right is a meta-narration of the governance of social contradiction.Therefore,the complicated social contradictions are resolved in legal logic framework and are clearly explained,integrated,well versed and developed.
