试论行政赔偿立法与构建和谐社会

健全的行政赔偿制度是构建和谐社会的内在要求,也是依法行政的应有之义。我国目前有关行政赔偿的法律还达不到和谐社会的要求,一系列的不和谐的声音由行政赔偿引起。为了更好地解决纠纷和维护人们的合法权益,我们必须在充分了解实际问题的基础之上不断地完善现行的行政赔偿制度。在这一思想的指导下,从行政赔偿范围、程序等方面就行政赔偿实践中遇到的难题进行分析并提出相应的对策,意在从理论上进行探讨。

The sound administrative compensation system is an inherent demand for structuring the harmonious society,a justice for administering the state according to law too.The law about administrative compensation can not still reach the requirement of harmonious society at present in our country,a series of sounds not harmonious are compensated and caused by the administration.In order to solve the dispute and legitimate rights and interests of safeguarding people better,we should perfect the present administrative compensation constantly on the basis of knowing the actual problems deeply.Under the guidance of this thought,this text compensate for from administration range,procedure respect difficult problem that run into analyzing and put forward the corresponding countermeasure on administrative compensation practice mainly.
