思想的流动与法治的构造——从当代中国人文精神思想角度的思考

法律是在思想文化中流动的.人文精神思想的流动和张扬,推动法治由过去简单的强调阶级斗争为纲或以权力为本位,转向以人为本,主张和谐法治,体现了当代法治、社会公平要符合人文精神理念的要求.这是中国改革开放30年在法治建设过程中所取得的重要成就.人文精神有着丰富的内涵,它总是反映出一定社会人们对自身的尊严和价值的强调,形成以人为本的价值理念.同时人文精神的内涵又是在现实社会生活中实现的,总和现实生活的种种问题交织在一起.从人文精神表现的文化内容而言,人文精神是对人自身价值加以肯定和张扬的道德范畴;人文精神可以体现于社会生活的各个方面,反映出一个社会或国家的文明程度;在当代现实生活中人文精神主要表现为对物欲主义的批判和超越;同时人文精神问题又是在多重的文化矛盾中运行.人文精神的思想文化对法治、社会公平的价值在于:人文精神要求张扬正义与拷问人性,是法治、社会公平理论的逻辑起点;要求追问法的合理性,是法治、社会公平的思维工具;主张自由、平等、人权、公正等,表现的是法治、社会公平所需要的价值文化要求.
