WTO机制下的美国贸易法“301条款”评述

美国贸易法"301条款"长期以来既是美国开拓海外市场和保护自身经济利益的最有力工具,又是美国应对国外贸易壁垒最重要的国内法依据之一,但其同时也是一项最富争议的贸易法规.虽然世界贸易组织早已确立了较为完善的争端解决机制,但美国始终不放弃"301条款",继续使用该法律对其他国家的贸易措施进行调查、谈判,甚至威胁和报复.中国作为深受其害的经济转型国家,有必要研究和积极应对,并以WTO争端解决机制为依托,借助多边框架据理力争,解决国际纠纷,多渠道地捍卫自己的权益.

Comments on Section 301 of the US Trade Law under WTO Mechanism

For a long time,Section 301 of the US Trade Law is the most effective tool that U.S.A.opens up the overseas market and protects its own economic benefits.It is also one of the most important domestic law bases of dealing with trade barriers of foreign countries.But at the same time,it is a disputable trade regulation too.Although WTO has set up relative perfect dispute settlement mechanism,U.S.A.doesn't give up section 301 and uses it to investigate,negotiate,even threaten and retaliate other countries.As the economic transition country,China should study Section 301 of the US Trade Law and draw supports from WTO dispute settlement mechanism.It's helpful for us to solve the international conflicts and defend our own rights and interests.
