| 摘 要： | ＂拼车＂是一种新兴的出行方式,目前并无专门立法针对其予以规范。因此明确＂拼车＂行为的法律性质及其所涉及主体间的法律关系就十分有必要。文章通过对拼车类型的列举、拼车行为性质以及相关主体间法律关系的分析,明确了＂拼车＂行为的基本概念及基本法律关系。拼车行为分为无偿和有偿两种,相关主体之间的法律关系也在此基础上有具体的区别,例如好意同乘、合同关系和合伙关系等等。
