和谐社会轻罪刑事政策的完善

和谐社会的刑事政策应当重视轻罪的妥善处置,树立宽严相济、宽缓为主的理念以及惩罚与矫正相结合、重在矫正的理念。我国现行轻罪刑事政策存在一些明显不和谐的因素,包括劳动教养制度以行政处罚之名行刑罚之实;过于倚重监禁刑,社区矫正刑太少;自由刑的执行重惩罚和隔离,轻教育改造。应当根据构建和谐社会的理念予以完善：从立法上实行重罪和轻罪的分类;从根本上改革劳动教养制度,制定保安处分性质的《违法行为矫正法》;立法上完善社区刑罚的设置,司法上和刑罚执行上提高社区刑罚的适用率;建立和完善刑事和解制度。
